Please read this software license agreement carefully. By installing, downloading, copying, or otherwise using the software, you acknowledge that you have read these terms and conditions, understand them, and agree to be bound by them. If you do not agree to these terms and conditions, you are not authorized and may not use the software.

Terms:
The software, the documentation and other materials accompanying this Agreement ("Software")
You as a person or the legal entity you represent ("You", "Licensee")

  1. The terms of this License apply to the maximum extent permitted by law. If any part of this Agreement is declared unenforceable by a court of law, the remainder will continue in full force and effect. This Agreement shall be governed by the laws of Germany, Europe.

  2. All rights not expressly granted in this License are reserved.

  3. Dirk Stichling grants you a non-exclusive license to use the Software. If you have not paid Dirk Stichling to use the Software, your use of the Software may be restricted in time or feature set. This restricted mode is intended for evaluation purposes only. In exchange for the license fee paid to Dirk Stichling you are granted a license for your unlimited use of the Software.

  4. Dirk Stichling may issue various types of licenses at varying price points (single user, 3-user, etc.). You shall note the terms of your license at the time of your purchase. These terms become a binding part of the present agreement.

  5. The Software is licensed, not sold, to you by Dirk Stichling for use only under the terms of this License. The rights granted herein are limited to Dirk Stichling's and its licensors' intellectual property rights in the Software and do not include any other patents or intellectual property rights.

  6. You may terminate this Agreement at any time. Your rights under this Agreement will also terminate automatically without notice from Dirk Stichling if you fail to comply with any term of this Agreement. Upon termination of this Agreement, you must cease all use of the Software and destroy all copies of the Software and License-Files in your possession.

  7. You may not modify, decompile, disassemble, reverse engineer, or create derivative works of the Software or portion thereof. You may not encourage, solicit, assist or instruct others to do so.

  8. You may not rent or lease the Software. You may sell your rights to use the Software. Such sale is possible only if the buyer agrees to be bound to the License. With the sale all rights and obligation of the License are transferred to the buyer.

  9. You may not use the software for any purpose that is unlawful or prohibited by this license agreement, or to solicit the performance of any illegal activity or other activity which infringes the rights of the authors or others.

  10. THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
